Brad Jones Visuals – Terms & Conditions

1. Acceptance of Terms

By booking a photography session, making payment, or using any images supplied by Brad Jones Visuals, you confirm that you have read, understood and agree to these Terms & Conditions.

2. Bookings & Payment

All photography sessions must be paid in full at the time of booking.

A booking is only confirmed once full payment has been successfully received.

Failure to attend a booked session without prior agreement may result in the full booking fee being forfeited.

For business-to-business transactions, statutory interest may be charged in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, where applicable.

3. Cancellations & Rescheduling

If you need to cancel or rearrange your booking, please provide as much notice as possible.

Requests to reschedule will be considered at the Photographer's discretion and are subject to availability.

Brad Jones Visuals reserves the right to postpone or reschedule a session due to:

Severe or unsafe weather conditions

Illness

Unsafe locations or conditions

Venue restrictions

Vehicle breakdowns or incidents affecting travel

Any circumstances beyond the Photographer's reasonable control

Where the Photographer is unable to carry out the session, an alternative date will be offered.

4. Travel Charges

Travel within 25 miles of Castleford, West Yorkshire is included within the booking fee.

Travel beyond this distance is charged at £0.50 per mile and will be agreed with the Client prior to the session.

5. Vehicle Responsibilities

The Client confirms that any vehicle presented for photography is roadworthy (where applicable), legally permitted to be driven on public roads and appropriately insured.

Brad Jones Visuals accepts no responsibility for any mechanical failure, accident, damage or loss relating to the Client's vehicle unless directly caused by the Photographer's proven negligence.

6. Copyright & Intellectual Property

All photographs, digital files and edited images remain the exclusive intellectual property of Brad Jones Visuals under the Copyright, Designs and Patents Act 1988.

Copyright is never transferred to the Client unless agreed in writing.

7. Personal Use Licence

Upon full payment, the Client is granted a limited, non-exclusive and non-transferable licence to use the supplied images for personal use only.

Images may not be:

Sold

Licensed to third parties

Used commercially

Altered or manipulated in a way that misrepresents the Photographer's work

Submitted for commercial publication without prior written permission

8. Commercial Use

Any commercial, advertising, promotional, sponsored, editorial or revenue-generating use requires a separate Commercial Licence agreed in writing before use.

Unauthorised commercial use may constitute copyright infringement and may result in legal action.

9. Image Delivery

Final edited images will be delivered through a secure online gallery.

The Photographer retains full creative control over image selection, editing style and final delivery.

RAW (unedited) image files will not be supplied.

10. Minors

Where any subject is under the age of 18, written consent from a parent or legal guardian must be obtained before the photography session takes place.

11. Data Protection

Personal information is processed in accordance with the Brad Jones Visuals Privacy Policy.

Information collected is used solely for booking administration, communication, image delivery and legal record keeping.

Personal data will never be sold or shared with third parties except where required by law.

12. Limitation of Liability

Brad Jones Visuals will take every reasonable care when providing photography services.

The Photographer's total liability shall not exceed the total amount paid by the Client for the relevant booking.

Nothing within these Terms excludes liability for death or personal injury caused by negligence or any liability which cannot legally be excluded under English law.

13. Punctuality

Clients are requested to arrive at the agreed meeting location on time.

Late arrival may reduce the available photography time and, where further commitments exist, the session will still conclude at the originally agreed finishing time.

14. Governing Law

These Terms & Conditions are governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
