1. ACCEPTANCE OF TERMS

By booking, paying a deposit, making payment, or using delivered images, the Client confirms full acceptance of these Terms & Conditions.

2. PAYMENT & DEPOSITS

A non-refundable deposit is required to secure all bookings. Full cleared payment must be received prior to final image delivery unless otherwise agreed in writing.

Failure to make payment by the due date may result in suspension of image delivery and automatic suspension of all usage rights.

For business-to-business transactions, statutory interest may be charged in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

3. COPYRIGHT & INTELLECTUAL PROPERTY

All photographs and digital files remain the exclusive intellectual property of bradjones.visuals under the Copyright, Designs and Patents Act 1988. No transfer of copyright shall occur under any circumstances.

4. LICENSE OF USE (NON-COMMERCIAL)

Upon full payment, the Client is granted a limited, non-exclusive, non-transferable licence for personal use only. The Client may not sell, sublicense, edit, alter, manipulate, or commercially exploit the images.

5. COMMERCIAL USE

Any commercial, advertising, promotional, sponsored, resale or revenue-generating use requires a separate written Commercial Licensing Agreement. Unauthorised commercial use constitutes

copyright infringement and may result in enforcement action.

6. TRAVEL & ADDITIONAL COSTS

Travel beyond included package allowance is charged at £0.50 per mile. Additional costs must be agreed in writing.

7. CANCELLATION & FORCE MAJEURE

Deposits are non-refundable. The Photographer reserves the right to reschedule due to illness, unsafe conditions, venue restrictions, adverse weather, or circumstances beyond reasonable control. The Photographer shall not be liable for losses arising from such events.

8. MINORS

Where subjects are under 18, a signed parent or guardian consent form is required prior to photography.

9. DATA PROTECTION

Personal data is processed in accordance with the Privacy Policy. Only essential contact data is collected for communication and delivery purposes.

10. LIMITATION OF LIABILITY

The Photographer’s total liability shall not exceed the total amount paid by the Client for the relevant services. Nothing excludes liability for death or personal injury caused by negligence.

11. GOVERNING LAW

These Terms & Conditions are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.
